1. Acceptance of terms

These Terms govern access to and use of RoofCaster websites, web dashboards, mobile applications, APIs, devices, campaign tools, analytics, support, and related services.

By creating an account, using the service, joining a workspace, operating an assigned device, or launching a campaign, you agree to these Terms. If you use RoofCaster for a company, you represent that you have authority to bind that company.

2. Accounts and workspaces

You must provide accurate account information, keep credentials confidential, and promptly notify us of unauthorized access. Workspace owners and administrators are responsible for user permissions, campaign activity, and compliance within their workspace.

We may suspend or restrict accounts that appear fraudulent, insecure, illegal, abusive, or in violation of these Terms.

3. Advertiser and campaign responsibilities

Advertisers are responsible for their campaign content, targeting, claims, trademarks, disclosures, permits, and compliance with advertising, privacy, consumer protection, transportation, and local laws.

Campaigns must not include illegal, deceptive, unsafe, discriminatory, infringing, malicious, or harmful content. We may reject, remove, pause, or require changes to campaigns at any time.

4. Driver, vehicle, and device responsibilities

Drivers and fleet operators must operate vehicles safely and legally, follow traffic laws, maintain required licenses, insurance, registrations, and authorizations, and only use RoofCaster devices as permitted.

Drivers must not tamper with devices, falsify location or proof-of-play data, obstruct displays where prohibited, or use the service while driving in a way that creates a safety risk.

5. Payments, pricing, and payouts

Campaign pricing, estimates, taxes, fees, driver earnings, bonuses, and payout timing may vary by campaign, geography, device status, proof-of-play, route verification, and workspace configuration.

Calculator outputs and dashboard estimates are informational until confirmed by the final invoice, payout ledger, or applicable written agreement. We may use payment processors and may withhold or adjust payouts for fraud, errors, chargebacks, policy violations, or legal requirements.

6. Data, analytics, and proof-of-play

RoofCaster may generate telemetry, campaign analytics, route data, proof-of-play logs, device diagnostics, and billing records. These records may be approximate and can be affected by connectivity, device state, location services, and third-party systems.

You may use reports for internal business purposes, but you may not misuse, scrape, re-identify, resell, or disclose personal data or confidential platform data unless authorized.

7. Intellectual property

RoofCaster and its software, designs, dashboards, workflows, analytics, logos, documentation, and technology are owned by RoofCaster or its licensors. We grant you a limited, non-transferable right to use the service according to these Terms.

You retain rights in campaign materials you submit, but you grant RoofCaster the rights needed to host, process, display, transmit, adapt for device formats, measure, and report on those materials for the service.

8. Prohibited uses

You may not reverse engineer, attack, overload, scrape, bypass security, interfere with devices, submit malware, violate laws, infringe rights, harass users, falsify data, or use RoofCaster for unauthorized surveillance.

You may not use the service to target people unlawfully, process sensitive information without a lawful basis, or run campaigns that create safety, discrimination, or consumer protection risks.

9. Third-party services

RoofCaster may integrate with maps, payment, authentication, hosting, analytics, communication, and other third-party services. Those services may have their own terms and privacy policies.

10. Disclaimers

The service is provided on an as-is and as-available basis to the fullest extent permitted by law. We do not guarantee uninterrupted service, perfect location accuracy, specific campaign performance, exact impression counts, or continuous device connectivity.

11. Limitation of liability

To the fullest extent permitted by law, RoofCaster will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.

Where liability cannot be excluded, it will be limited to the amount paid to RoofCaster for the service giving rise to the claim during the twelve months before the event, unless applicable law requires otherwise.

12. Indemnity

You agree to defend, indemnify, and hold RoofCaster harmless from claims arising from your content, campaigns, vehicle or device use, workspace administration, violation of these Terms, or violation of law or third-party rights.

13. Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms, create legal or security risk, fail to pay, or if continued service is not commercially or legally practical.

Sections that by their nature should survive termination will survive, including payment obligations, intellectual property, disclaimers, limitations of liability, indemnity, and dispute provisions.

14. Governing law and disputes

Unless a separate written agreement says otherwise, these Terms are governed by the laws of the jurisdiction where the RoofCaster contracting entity is established, without regard to conflict-of-law rules.

Before filing a claim, each party will try to resolve disputes informally by contacting legal@roofcaster.com. Venue, arbitration, or other dispute procedures should be finalized with the contracting entity before production launch.
